Terms of Service

The short version: Sunken Sands is a free block-puzzle game made by ToneNite BV in Belgium, for players aged 13 and up. An account is optional. Coins and bricks are game items with no real-world value. Play fair in online duels, be decent in your builder name, and don't cheat. Ads are optional, rewarded, and never personalized. Belgian law applies — and nothing in these terms limits your statutory consumer rights.

By playing Sunken Sands, or by accepting these terms in the game (for example before using online features), you agree to them. If you do not agree, please don't use the game.

You must be 13 or older to play (13 is the digital-consent age in Belgium). If you are under 18, please make sure a parent or guardian is okay with you playing and agrees to these terms on your behalf. The game includes a parental-controls panel where a parent can set a PIN and disable purchases entirely.

3. Your license to play

We grant you a personal, non-exclusive, non-transferable, revocable license to install and play the game on devices you own or control, for your own entertainment. The game is licensed to you, not sold. We regularly update the game and may add, change, rebalance or remove features and content over time.

4. Accounts & cloud save

You can play without an account. Optionally, you can sign in with Google or Apple to save your progress and play on any device. You are responsible for keeping access to that Google/Apple account secure. You can delete your Sunken Sands account and its server data at any time in the game via Settings → Delete account. How we handle personal data is described in our Privacy Policy.

5. Builder names & conduct

You can choose or type a builder name that other players may see in online duels. Names must not be offensive, hateful, misleading or impersonate someone else. We filter names and may reset a name that slips through. When you play with others, be a good sport: no harassment, no abuse.

6. Coins, bricks & other virtual items

The game uses virtual items such as bricks (earned by playing) and coins (earned in the game and, in the future, available for purchase). Virtual items:

The game contains no paid chance-based items (no paid loot boxes): if you ever buy something, you can see exactly what you get before you buy it.

7. Purchases

If and when in-app purchases are available, they are processed by Apple (App Store) or Google (Google Play) under their payment terms; prices are shown in the store, including VAT. A parental gate protects purchases, and purchases can be disabled completely in the parental-controls panel.

EU right of withdrawal: when you buy digital content such as coins, you ask us to deliver it immediately; by doing so you acknowledge that you lose the 14-day right of withdrawal once delivery has started (Article VI.53, 13° of the Belgian Code of Economic Law). Your statutory rights, including the legal guarantee for digital content, are not affected. Refund requests are otherwise handled through Apple or Google.

8. Ads

The game shows optional rewarded ads (you choose to watch an ad in exchange for an in-game reward) through Google AdMob. Ads are served non-personalized and in a child-safe configuration — they are not based on a profile of you. See the Privacy Policy for details.

9. Online duels & fair play

Online duels run on our server in the EU. Don't cheat: no exploits, no automation or scripting, no tampering with the game or its network traffic, and no disrupting other players. We may suspend or end access to online features — and in serious cases the account — of anyone who breaks these rules.

10. Intellectual property

The game, including its art, music, code, names and design, belongs to ToneNite BV or its licensors. You may not copy, distribute or create derivative works from it except as allowed by law. If you send us feedback or ideas, you allow us to use them to improve the game without obligation to you.

11. Availability & changes

We work hard to keep the game and its online features available, but we cannot promise uninterrupted service. Online features (such as duels and cloud save) may occasionally be down for maintenance and may change over time. If we ever discontinue a feature that materially affects something you paid for, we will give reasonable notice where possible.

12. Liability

Nothing in these terms excludes or limits our liability for fraud, intent or gross negligence, or any other liability that cannot be excluded under Belgian law. For the rest, we are only liable for foreseeable damage that is directly caused by our failure, and our total liability is limited to the amount you paid us in the 12 months before the event — or €50 if you paid nothing. Your statutory consumer rights remain fully intact.

13. Ending things

You can stop playing at any time and delete your account in the game. We may suspend or terminate access if you seriously or repeatedly break these terms; where reasonable, we will warn you first.

14. Changes to these terms

We may update these terms as the game evolves. If we make material changes, we will announce them in the game or on this site and update the date above. If you keep playing after a change takes effect, the new terms apply. If you don't agree with a change, you can stop using the game and delete your account.

15. Governing law & disputes

These terms are governed by Belgian law. If you live elsewhere in the EU, you also keep the protection of any mandatory rules of your own country. Disputes can be brought before the competent Belgian courts, or the courts your local consumer law designates.

As a consumer you can also contact the Belgian Consumer Mediation Service (Consumentenombudsdienst, consumentenombudsdienst.be) for out-of-court dispute resolution.
